Published in the first issue of Spencer’s Art Law Journal Vol. 1, No. 1, Spring 2010, the article by Arabella Yip, Assistant General Counsel, Yale University, explores the jurisdictional issues behind the settlement in February 2009 of a case involving the Museum of Modern Art (MoMA) in New York and one of its most valuable paintings, Boy Leading a Horse (1905-1906) by Pablo Picasso. Under the terms of the settlement, the museum was allowed to keep the painting in exchange for paying an undisclosed sum of money to the claimant.
