Hungary Passes Law Enabling Recovery of Looted Works of Art in Its Public Collections 11 November 2013

On 11 November 2013 the Hungarian Parliament passed legislative amendments proposed by the Minister of Human Resources, Zoltán Balog. In the future, the burden of proof will be on the state to prove the legality of its ownership of works of art in its public collections. Under the amendments, if the state cannot meet its burden of proof, then it will be obligated to return the works of art in question to whomever can make a “prima facie case” of his/her ownership.The amendments were followed by an Executive Decree enacting the legislation.
